Welcome to bomtastic! These Terms and Conditions govern your use of the bomtastic website and app, operated by Olaf Ken Wenzel, Software & Consulting, doing business as bomtastic (“we”, “us”, or “our”).

By using our website and app, you agree to the following terms and to our Privacy Policy.

1. User Account and Registration
   To use the app, you must register and create a user account. You are required to provide accurate information during registration and to keep your password confidential. You are responsible for all activities conducted through your account.

2. Use of the App
   Our app is designed for the structured management of lists. It may only be used for lawful purposes. The use of the app to distribute illegal, offensive, or harmful content is prohibited.

3. Premium Services and Subscriptions
   The service offers paid additional features (“Premium”), the scope and pricing of which are clearly presented before subscription. Billing is handled by third-party providers (e.g., Google Play, Apple App Store, Paddle.com) in accordance with their terms and conditions. Subscriptions renew automatically unless cancelled in due time.

4. Refund Policy
   For paid subscriptions and digital content, applicable consumer protection laws apply.

   Consumers generally have the right to withdraw from a contract within 14 days of purchase. This right of withdrawal may expire early if, at the time of purchase, you expressly agree that we begin providing the digital content or services before the end of the withdrawal period and you acknowledge that you thereby lose your right of withdrawal.

   Subscriptions may be cancelled at any time. Cancellation takes effect at the end of the current billing period. Amounts already paid are not refunded, unless a refund is required by applicable law.

   Payments and any applicable refunds are processed via the respective payment provider (e.g. Paddle.com, Google Play, Apple App Store) and are subject to that provider’s terms and refund policies.

5. Content and Data
   The lists you create remain your property. We do not access or share your content with third parties unless legally required to do so. We strive to ensure the highest possible data security but cannot guarantee absolute protection.

6. Intellectual Property
   All rights to the app, its design, logo, and underlying code are owned by us. Unauthorized reproduction or distribution is prohibited.

7. Disclaimer of Liability
   The app is provided “as is” without any guarantees. We accept no liability for direct or indirect damages arising from the use of the app.

8. Privacy Policy
   For information on how we handle personal data, please refer to our Privacy Policy.

9. Changes
   We reserve the right to amend these terms at any time. In the event of significant changes, we will notify you via the email address provided or upon your next login.
